| + | Sunday 13th August 2006 | ||
| + | |||
| + | A race to a mark the Saundersfoot side of Caldy and back. It was blowing quite a bit. The first leg was a run. Basically it was far too wavey to really go for it - I've never been so wet, even in a Cherub. | ||
| + | |||
| + | From the second the start gun went I was under a wall of water from the bow. As we neared the leeward mark Simon (Goodwin - crew) was shouting at me we should gybe. I was underwater trying to keep it going straightish. A few more hollers from Si and he figured I couldn' | ||

| + | Mr Lee, I am writing to inform you that your use of the trade mark YELLOW | ||

| + | property rights. | ||
| + | I appreciate that this may have been a genuine mistake, so I kindly ask | ||
| + | that you remove all use of the infringing trade mark from your website | ||
| + | and/or any other materials immediately and confirm to me by way of letter | ||
| + | that the removal has taken place and the trade mark will not be used in the | ||

| + | Dear Mr MacIntyre, | ||
| + | Thank you for your email. I am flattered that our tiny concern has drawn | ||
| + | the attention such an organisation as Yell. Can you tell me how you found | ||
| + | out about us? Are you a sailor? | ||
| + | You can be assured that any infringement of any intellectual property | ||
| + | rights concerning the trade mark YELLOW PAGES would be an accident, and | ||
| + | that as soon as we know what it is we must do, we'll do it. | ||
| + | | ||
| + | website infringe the rights you claim, and how we can verify your claim? I | ||
| + | imagine you would like us to change the name and the graphic on the front | ||
| + | page? | ||
| + | Alternatively we would be very happy to use the YELLOW PAGES name with | ||
| + | permission if it were to be granted. We could display a note showing that | ||
| + | we have obtained permission, complete with a link to www.yell.com. | ||
| + | Whichever you prefer. | ||
| + | Lastly, all comunication with us will be by email as we are a paper-free | ||
| + | organisation. | ||
| + | Best wishes, and thanks for writing me the most interesting email of the day. | ||

| + | Thank you for your prompt response. | ||
| + | I attach 2 screen shots of your website' | ||
| + | mark which prompted my initial email. While the intention of your site may | ||
| + | be non-commercial, | ||
| + | Pages' advertisers and claims to receive 110,000 hits a year suggests | ||
| + | otherwise, for trade mark purposes atleast. | ||
| + | As we are not in a position to licence use of our trade mark to you, we | ||
| + | would be grateful if you can simply please replace the words " | ||
| + | Yellow Pages" and " | ||
| + | similar to, our trade marks. Note we also have a trade mark in Business | ||

| + | Thank you in advance for your cooperation in this matter. | ||

| + | Dear Mr MacIntyre, | ||

| + | In accordance with your request we have replaced the YELLOW PAGES artwork, | ||
